Distance does not make a Gurugram property purchase unsafe; fragmented responsibility does. An NRI buyer needs one coordinated record connecting eligibility, source of funds, project diligence, signing authority, tax handling and physical inspection.

Confirm what you may acquire

Foreign-exchange rules distinguish residential or commercial property from agricultural land, plantation property and farmhouses. Eligibility can depend on citizenship and residency status. Review the current RBI/FEMA framework and obtain professional advice before paying a token—particularly if the asset is plotted, inherited, jointly purchased or outside a conventional apartment transaction.

Keep the money trail simple

Use permitted banking channels and accounts appropriate to your status. Ask your bank or adviser how the purchase price, taxes, loan and later sale proceeds should be routed and documented. Avoid informal reimbursements or payments to accounts not named in verified transaction documents.

Create a payment register with date, purpose, amount, bank reference, recipient and receipt for every transfer.

Separate advisory roles

One person should not be the sole source of the property, legal opinion, valuation and site report. A resilient team may include:

  • an independent property lawyer;
  • a chartered accountant or tax adviser familiar with NRI transactions;
  • a lender or authorised dealer bank where financing is involved;
  • a technical inspector for completed property;
  • a local representative with a narrowly defined role.

Ask each adviser to report directly to you in writing.

Use a limited power of attorney carefully

If someone will sign or complete registration on your behalf, have a lawyer draft or review the authority for the specific transaction. Understand execution, notarisation, consular or apostille requirements, stamping or adjudication in India and the limits placed on the representative.

Do not issue a broad authority merely because it is convenient. Keep originals and a record of every action taken under it.

Verify the project and seller independently

For a new project, search the exact phase on Haryana RERA and match the promoter, plans and timeline with the agreement. For resale, review title, prior conveyance, loan status, maintenance dues and seller identity.

Arrange a live video inspection, but do not stop there. Commission dated photographs, room measurements and a written defect or construction-status report.

Understand withholding before paying the seller

Tax withholding differs depending on whether the seller is resident or non-resident and on the transaction facts. The common property-buyer process for a resident seller should not be applied automatically to an NRI seller. Obtain transaction-specific advice before the first instalment and plan timelines for any required certificates or filings.

Also ask how rental income, ownership costs and an eventual sale would be reported in India and in your country of residence.

Review the all-in cost in your base currency

Your rupee cost sheet should include purchase consideration, stamp duty, registration, applicable tax, maintenance deposits, legal review, brokerage, loan charges, fit-out and travel. Then stress-test the amount against exchange-rate movement rather than assuming today’s conversion rate.

Plan the registration trip—or remote completion—early

Confirm the document list, appointments, witnesses, biometric requirements and representative authority well in advance. Names and signatures should be consistent across passport, PAN, bank, tax and property records. Correct discrepancies before the scheduled registration window.

Design the operating plan before handover

Decide who will inspect possession, prepare the snag list, manage utilities, hold keys, supervise interiors and monitor the property. If the home will be rented, define tenant selection, inventory, rent collection, repairs and periodic physical inspections.

A practical NRI transaction file

Maintain a secure index containing identity and tax documents, residency evidence, bank advice, RERA records, title report, plans, agreement versions, power of attorney, payment receipts, tax filings, registration documents and handover records. Share only the minimum necessary subset with each party.

The objective is not merely to complete remotely. It is to create a transaction that another professional can audit from the file years later.
